These Terms and Conditions (“Terms”) govern your access to and use of Csium (“the Platform”), operated by Csium LLC, a Colorado Limited Liability Company, (“Company,” “we,” “our,” or “us”). By using the Platform, you agree to comply with these Terms. If you do not agree, you may not access or use Csium.

Acceptance of Terms

By creating an account or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

• You must be at least 18 years of age to use Csium.
• You agree to use the application only for lawful purposes and in accordance with these terms and conditions.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

User Responsibilities

You are solely responsible for your interactions on the Platform and any content you upload, post or share, included but not limited to videos, pictures, comments, and any other materials (“User Content”).

You agree that you will:

• Provide accurate and complete information when creating an account.
• Be solely responsible for any activity that occurs under your account.
• NOT upload, share, or post content that violates any laws, including copyright, trademark, or intellectual property laws.
• NOT upload or post content that is hateful, malicious, threatening, harmful, abusive, defamatory, harassing, obscene, or otherwise inappropriate.
• NOT use the Platform for any political or commercial purpose.
• NOT use the Platform for any illegal or unauthorized purpose.
• NOT impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• NOT attempt to interfere with or disrupt the integrity of the Platform, including using viruses, malware, or other malicious software.

We reserve the right to suspend or terminate accounts that violate our terms or are suspected of unauthorized activity.

Account Information

For every team member You authorize to use the Platform, a User account will be created where we collect information, including but not limited to their name and last name, email address, password, phone number.

Subscription and Payments

Some features of Csium may require a paid subscription. Subscription fees are billed on a recurring basis unless canceled. Refunds are subject to our refund policy.

Refunds

We want you to be satisfied with your experience using Csium. However, please note the following refund policy:

• Except when required by law, paid Subscription fees are non-refundable.
• Users can cancel their subscription at any time, and they will continue to have access to the Platform until the end of their current billing period. No prorated refunds will be issued for unused portions of a subscription.
• If you believe that Csium has charged you in error, you must contact us within 14 days of such charge.
• We reserve the right to issue refunds or credits at our sole discretion.
• We reserve the right to modify this refund policy at any time. Any changes will be communicated via our website or within the app.

Canceling the Service

You may cancel Csium at any time, with or without cause through the app settings. Upon cancellation, you will continue to have access to your data but not the app’s features. No further charges will be made after your current subscription term ends. Deleting the app from your device does not cancel your subscription; you must cancel it through the designated channels.

Deleting Account

You may delete your account at any time through the app settings. Once your account is deleted, you will no longer have access to your data, and all stored information will be permanently deleted. Deleting your account does not automatically cancel your subscription. You must cancel your active subscription first to avoid future charges.

Intellectual Property

Csium and its original content, features, and functionality are owned by Csium LLC and are protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on our content without prior written permission.

Account Termination

Csium reserves the right to suspend or terminate your account without notice if you violate these Terms or engage in conduct that we determine is harmful to the Platform, its users, or third parties. Upon termination, your right to use the Platform will cease immediately, and we may delete any content or data associated with your account.

Limitation of Liability

To the fullest extent permitted by law, Csium, the Company, its members, managers, employees, and agents shall not be liable for any direct, indirect, incidental, or consequential damages, including:

• Any loss, theft, or damage to User Content.
• Claims arising from the unauthorized use or distribution of your content.
• Claims resulting from your use or inability to use the Platform, including but not limited to damages for lost profits, goodwill, data, or other intangible losses.

You agree to release, defend, indemnify, and hold harmless Csium and its affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights.

Disclaimer of Warranties

The Platform is provided on an “as-is” and “as available” basis without any warranties of any kind, express or implied. We do not guarantee that the Platform will be error-free, secure, or uninterrupted. You use the Platform at your own risk. We are not liable for any damages arising from your use of the app, including but not limited to loss of data, business interruptions, or financial losses. We disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement. Csium makes no representations regarding the accuracy, completeness, or timeliness of the content available on or through the Platform.

Modifications to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform after any changes to the Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
